Terms of service
Last updated: [DATE]
Draft. This page is under review, and the details in brackets are being confirmed.
These terms are an agreement between you and Photic Labs Private Limited, a company incorporated in India (CIN [CIN]), registered office [REGISTERED ADDRESS] (“we”, “us”). They cover your use of Photic Labs, our software service that turns your app's screen recordings into short marketing videos. Contact: [CONTACT EMAIL].
By creating an account, you accept these terms. If you use Photic Labs for a company, you accept them for that company and confirm you may do so. You must be 18 or over.
1. Payments through Paddle
Paddle.com is our reseller and the merchant of record for every purchase. You buy from Paddle, which handles:
- checkout and payment;
- sales tax and VAT;
- invoices;
- billing support and refund processing.
Paddle's buyer terms also apply to your purchase. Prices are in US dollars, and Paddle adds any tax at checkout.
2. Credits
- What a credit buys: one credit pays for one exported video up to 30 seconds. A video of 31 to 60 seconds costs 2 credits.
- What's free: generating drafts, editing them, and anything that fails our checks.
- Where credits come from: a plan's monthly allowance, or a credit pack, which you can buy with or without a plan.
- Expiry: plan credits expire at the end of the billing period they belong to: a month on monthly billing, a year on annual billing. Pack credits expire 12 months after purchase. Exports use the credits that expire soonest first.
- What a credit isn't: credits have no cash value. They can't be transferred, sold or exchanged, and they buy only videos on Photic Labs. Unused credits aren't refunded when they expire, except under the refund policy.
- Draft limits: we limit how many unexported drafts you can hold at once. The limit is shown in the app.
- Re-exports: re-exports and fixes follow the rules on the pricing page.
3. Free exports
Each app listing gets 3 free exports, with a watermark and no card required. The allowance belongs to the listing, not the account, so a second account for the same app gets none.
4. Plans, renewal and cancellation
- Renewal: plans renew automatically at the end of each billing period until you cancel.
- Cancelling: you can cancel in the app in one step. Cancelling stops the next renewal, and you keep your plan and its credits until the period ends.
- Upgrading: an upgrade takes effect at once. You pay the prorated difference for the rest of the period and get the same share of the extra credits.
- Downgrading: a downgrade takes effect at your next renewal.
- Price changes: we may change prices for future periods. We'll tell you at least 30 days before a change reaches your renewal.
5. Refunds
See our refund policy. It doesn't limit any right you have under the law where you live.
6. Your content
You keep all rights to what you upload or approve:
- footage, screenshots and hook clips;
- app listing content and context files;
- the brief and the claims.
You give us permission to store, process and transform that content to provide Photic Labs to you, including through the service providers in our privacy policy. We don't use your content to train AI models.
You confirm that:
- you have the rights to everything you upload;
- anyone who appears or speaks in a hook clip has agreed to it;
- the claims you approve are true and you can support them.
Photic Labs keeps scripts to the claims you approve, but you're responsible for what your videos say once you publish them.
7. Your videos
Videos you export with paid credits are yours to use, including in ads and on social platforms. Free exports carry a watermark. Exports include machine-readable provenance data (C2PA) that identifies AI-generated elements, such as synthetic narration. Follow each platform's rules for labelling AI content when you post.
8. Acceptable use
Don't use Photic Labs to:
- break the law;
- make false or misleading claims about any product;
- use footage, voices or likenesses you have no right to use;
- impersonate anyone;
- harass anyone;
- break Paddle's acceptable use policy.
Don't try to get around the service's limits or security, or overload it. We may suspend an account that breaks these rules, and we'll tell you why.
9. The service
We work to keep Photic Labs available and correct, but we provide it “as is”. We don't guarantee that a video will reach any audience or result. We may change or stop features. If we stop Photic Labs altogether, we'll give at least 30 days' notice so you can use your credits and download your videos.
10. Liability
As far as the law allows:
- our total liability for any claim is limited to what you paid us in the 12 months before it arose;
- we aren't liable for indirect or consequential loss, such as lost profits.
Nothing here limits liability that can't be limited by law.
11. Ending the agreement
You can stop using Photic Labs and delete your workspace at any time in Settings. We may end the agreement if you seriously break these terms. Sections 6 (your licence to us ends when your data is deleted), 7, 10 and 12 survive.
12. Law and disputes
These terms are governed by the laws of India. The courts of [CITY], India have jurisdiction, unless the law where you live as a consumer gives you the right to bring a claim there.
13. Changes to these terms
If we change these terms, we'll update the date above. If a change is significant, we'll tell you in the app or by email at least 14 days before it takes effect. If you keep using Photic Labs after that, you accept the change.
